Terms of service
These terms govern your use of www.atlanticcricketgear.com and any purchase you make from Atlantic Cricket Gear. By using this site or placing an order you agree to them. Please read them together with our refund policy, shipping policy and privacy policy.
1. Who we are
Atlantic Cricket Gear is an online cricket equipment retailer based in Surrey, British Columbia, Canada. In these terms, "we", "us" and "our" mean Atlantic Cricket Gear, and "you" means the person using the site or placing an order.
2. Eligibility
You must be at least the age of majority in your province, state or country of residence to place an order, or have the consent of a parent or guardian. You agree that the information you give us at checkout is accurate and complete.
3. Products, descriptions and pricing
We try to describe and photograph every product accurately. Cricket bats are made from natural willow, so grain count, colour, markings and weight vary between individual bats, and photographs are representative rather than exact. If you need a specific weight or pick-up, contact us before ordering and we will measure the actual bat in stock.
All prices are in Canadian dollars unless stated otherwise and exclude taxes, shipping, and any import duties. We may change prices, product ranges and availability at any time without notice. Occasionally a product or price may be listed incorrectly; where that happens we may cancel the affected order and refund you in full, and we will contact you before doing so.
4. Orders and acceptance
Your order is an offer to buy. We accept it when we send you a shipping confirmation. We may refuse or cancel any order, including where the item is out of stock, the pricing was incorrect, or we suspect fraud or resale in breach of these terms. If we cancel an order after payment, we refund it in full.
Payment is taken at checkout through Shopify's payment processing. We do not store your full card details.
5. Shipping, returns and warranty
Shipping is governed by our shipping policy, and returns and refunds by our refund policy. Both form part of these terms.
Products are covered by their manufacturer's warranty, on the manufacturer's terms. We are not the warranty provider and the manufacturer's decision on any claim is final. See our knocking-in and warranty page for how claims work.
6. Safe use of equipment
Cricket carries an inherent risk of injury. Protective equipment reduces that risk but cannot eliminate it. You are responsible for choosing correctly sized equipment, for fitting and inspecting it before use, and for replacing it when it is damaged or worn. Helmets must meet the standard required by your league or competition. Bats must be prepared before use as described on our knocking-in page.
7. Custom and personalised items
Laser engraving and other personalisation is produced from the text and artwork you approve, and personalised items are final sale. By submitting artwork you confirm you have the right to have it reproduced, and you agree to indemnify us against any third-party claim arising from it. We may decline any artwork at our discretion.
8. Acceptable use
You agree not to use this site for any unlawful purpose, to attempt to gain unauthorised access to it, to interfere with its operation, or to scrape or copy its content for commercial use without our written permission.
9. Intellectual property
The Atlantic Cricket Gear name, logo, site design and original content belong to us. Manufacturer names, logos and product images are the property of their respective owners and are used to identify the products we sell.
10. Limitation of liability
To the fullest extent permitted by law, our total liability arising out of any order is limited to the amount you paid for the product concerned. We are not liable for indirect or consequential loss. Nothing in these terms excludes or limits any liability that cannot lawfully be excluded, including under applicable Canadian consumer protection law.
11. Governing law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. The courts of British Columbia have jurisdiction over any dispute.
12. Changes and contact
We may update these terms from time to time; the version published here at the time of your order is the one that applies. Questions about these terms: akshayn1388@gmail.com.
